5 YEAR FADE RESISTANCE WARRANTY

Curbside Xpressions, LLC ("Curbside") warrants in the limited manner specified herein that the materials used and or manufactured by Curbside shall be free from defect in the manufacture of the product and materials. For a period of Five

(5) years from the date of sale, when installed in accordance with Curbside’s current published literature, the product manufactured by Curbside will resist pealing, fading, leaning and damage.

THE SOLE RESPONSIBILITY AND LIABILITY OF CURBSIDE UNDER THIS WARRANTY SHALL BE TO PROVIDE LABOR AND MATERIALS NECESSARY TO REPAIR OR REPLACE THE CURBSIDE PRODUCT DESCRIBED HEREIN SHOWN TO BE DEFECTIVE DURING THE WARRANTY PERIOD, AND ONLY FOR THE MATERIALS WARRANTED HEREUNDER. ANY OTHER LABOR OR OTHER COSTS ASSOCIATED WITH THE REPAIRS OR REPLACEMENT SHALL BE THE SOLE RESPONSIBILITY OF THE OWNER. NO OTHER CHARGES OR EXPENSES WILL BE ALLOWED BY CURBSIDE.

CURBSIDE WILL DETERMINE IN ITS SOLE DISCRETION THE APPROPRIATE SCOPE AND METHOD OF REPAIR OR REPLACEMENT TO REMEDY ANY CONDITION COVERED BY THIS WARRANTY.

No warranty whatsoever is made with respect to

• materials produced by other manufacturers not bearing Curbside name or logo which are used in the installation and or manufacturing of the Curbside products covered hereunder,
• materials produced by other manufacturers for Curbside, even if such materials bear Curbsides name or logo,

This warranty is void if Curbside products are intermixed with other chemicals or materials not specifically required by Curbside’s current published literature.

No warranty whatsoever is made for damage caused in whole or in part by acts of God or natural phenomenon, such as but not limited to falling objects, fire, earthquake, floods, pests or chemical fumes, automobiles or direct contact of heavy equipment.

No warranty whatsoever is made for any damage or injury not solely and directly caused by defects in the manufacture of the product covered under this warranty.

IN NO EVENT SHALL CURBSIDE BE LIABLE FOR AND EXPRESSLY DISCLAIMS ANY LIABILITY FOR ANY DAMAGE TO THE PRODUCT ITSELF, ITS CONTENTS OR FOR ANY CONSEQUENTIAL, SPECIAL OR INCIDENTAL DAMAGE, WHETHER IN CONTRACT OR IN TORT, INCLUDING NEGLIGENCE. THIS LIMITED REPAIR AND REPLACEMENT WARRANTY IS GIVEN IN LIEU OF ANY AND ALL OTHER WARRANTIES WRITTEN OR ORAL, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE REMEDY SET FORTH HEREIN IS THE SOLE AND EXCLUSIVE REMEDY FOR ANY AND ALL CLAIMS ARISING UNDER OR

IN CONNECTION WITH OR IN ANY WAY RELATING TO THE CURBSIDE PRODUCTS AND THE INSTALLATION OF THE PRODUCTS. NO CURBSIDE REPRESENTATIVE HAS THE AUTHORITY TO VARY OR ALTER THESE TERMS.

This warranty is issued to the original owner of the Curbside products into which the Curbside products have been incorporated and may only be transferred or assigned to a subsequent owner upon written notice to Curbside at the address provided below at the time of transfer of ownership. Such transfer or assignment shall not extend the original term of this limited repair and replacement warranty.

No warranty stated herein shall be effective until and unless the product covered by this warranty have been paid for in full, proof of purchase and registration with Curbside Xpressions LLC, online or by mail. The remedies provided in this warranty shall be exclusive and no person is authorized to make any other warranty, express or implied, on behalf of Curbside.

Curbside warrants this product against defects in materials and workmanship.

Curbside Xpressions LLC. warrants to the original consumer purchaser of this mailbox column product for 5 years on which it is originally purchased and that it is sold free of latent defects in materials, parts and workmanship. This warranty is limited to repair or replacement of the defective mailbox column product. All defective products must be returned freight prepaid to Curbside Xpressions LLC. factory. If the unit is determined to be defective, it will be repaired or replaced free of charge at Curbside option. This warranty does not include repair or replacement due to defects caused by abuse, misuse, fire, vandalism, substandard or nonconforming installation, contact with destructive weather conditions (includes salt air, road salt or other corrosive materials). This warranty does not cover the labor or any other cost of removal, re-installation or replacement of, or as a consequence of, the defective mailbox column product. This warranty does not cover field expenses or the cost of any items other than the defective mailbox column product. Consequential damages to property are excluded.
